1. The amount of the monthly housing allowance paid by the PHA to the owner is determined by the PHA in accordance with the requirements of the HUD Directive and other requirements. The amount of the housing allowance may vary during the duration of the hap contract. (A) The HAP contract provides for penalties against the PHA for late payment of housing allowances to the landlord if all the following circumstances apply: (iii) The family is not responsible for paying the portion of the rent to the landlord covered by the housing allowance under the HAP contract between the landlord and the PHA. See point 982.310 (b). (B) The PHA is not required to pay a late penalty if HUD finds that late payment by IRPs is due to factors outside the PHA`s sphere of influence. The PHA may add provisions of the PAH contract that determine the date on which the payment of the housing allowance by the PHA is considered received by the owner (for example. B for derpost by the PHA or when receiving it effectively by the owner). (i) The PHA must pay the housing allowance immediately if it is due to the landlord in accordance with the PAH contract. (1) The HAP contract must be carried out in the form required by HUD. (2) The duration of the HAP contract is the same as the duration of the lease.

(2) The PHA`s monthly housing allowance is charged to the landlord`s monthly rent as part of the family`s rental agreement. (3) The rent paid by the tenant, plus the payment of PHA housing assistance to the landlord, can only be rent to the landlord. The owner must immediately return any overpayments to the PHA. (3) The landlord also applies such penalties against the tenant for late payment of the family rent to the landlord. (iii) the PHA may only use the following sources to pay a late penalty on program revenues under the consolidated CCA: revenue from program management fees; or the reserve of administrative costs for the program. The PHA must not use any other access to the program for this purpose. (ii) The landlord must not request or accept a rent payment to the tenant that goes beyond this maximum amount and must immediately return any rental payment to the tenant. (2) It is the owner`s practice to impose such penalties on assisted and un assisted tenants; and (i) The portion of the rent paid by the tenant may not be greater than: (B) The payment of PHA housing assistance to the landlord.

(1) These sanctions are consistent with generally accepted practices and laws that apply in the local housing market and regulate penalties for late payment of rent by a tenant;
